At Zeacloud Services Private Limited, hereinafter referred to as "Zeacloud," "We," or "Our," we respect your privacy and are committed to protecting your Personal Data in compliance with the Digital Personal Data Protection Act, 2023 (DPDPA), the EU General Data Protection Regulation (GDPR), and the Information Technology Act, 2000. This Privacy Policy discusses how Zeacloud collects, uses, maintains, and discloses information collected from our customers, visitors to our websites, individuals who contact us, and visitors to our customers' websites ("Users"). Please review this Privacy Policy in conjunction with our Terms of Use Agreement and any specific Service Agreement, as the terms of this Policy are in addition to and supplement those contracts. We offer products and services provided by third parties ("Third-Party Products"), and while we are not responsible for their data practices, we will, where possible, provide You with access to their privacy terms upon request. We reserve the right to change this Privacy Policy at any time, with material changes being communicated via our website or email.

You hereby acknowledge of having read and accepted the terms of the Privacy Policy by use of this Website and/or otherwise by virtue of expressly consenting to provide us with your personal information. This Privacy Policy and its enumerated policies are intended to comply with provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 and Digital Personal Data Protection Act, 2023.

1. Information That We Collect and Lawful Basis for Processing

We collect information from Users in many ways, and our processing is always based on a lawful principle as required by the DPDPA and GDPR. Customer Record includes information such as name, address, email address, phone number, company affiliation, and credit card number, collected when You become a customer. Provided that, any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as sensitive personal data or information. This information is processed under the Legal Basis of Contractual Necessity to provide the Services and for billing. Inquiry Information is collected when Users contact us for sales or support, and this is processed under the Legal Basis of Legitimate Interest to respond to your queries or under Consent if required for promotional contact. Statistical Information collected from our servers includes Users' IP addresses, dates of visit, operating system, and browser data. This is initially processed under Legitimate Interest for network maintenance and security. Survey Information provided voluntarily by Users in response to surveys, questionnaires, and requests for information is processed based on your explicit Consent. Our website and Services utilize Cookies and Tracking Software (such as Google Analytics and web beacons) to track page visitation, session data, and responses to promotional activity. The use of all non-essential cookies and tracking technologies is based on your explicit Consent provided via our Cookie Consent Management Tool.

2. Information We Collect Automatically (Technical Data)

In general, You can visit our Website without revealing your identity. However, we routinely collect certain technical and analytics information about your device and use of our Website. This includes the Internet Protocol (IP) address from which You visit us, which enables us to maintain communication with your device and allows us to approximate your geographical location and country. We also automatically receive information from your web browser concerning which pages You visit within our Website, which Website You visited before coming to ours (referral data), and where You go after You leave. The Lawful Basis for collecting this Technical Data is Legitimate Interest, specifically for maintaining the security and stability of our Services, diagnosing server problems, preventing fraudulent or harmful activity, and improving the design and content of our Website. We use this information in the aggregate to develop statistics that measure the use of our Website and to continuously optimize its content and format. Certain other information may also be collected automatically from your device, such as browser settings and operating system details, if permitted by your device/browser settings, and is used solely to display the Websites correctly on your device. We will not retain Personal Information that we have collected for a duration longer than is required for the purposes for which the information was collected to be used, as stated herein, or as otherwise required to be retained under any applicable law for the time being in force.

3. Log Files and Network Data

Zeacloud's web servers and network equipment automatically log certain operational data, which is always provided by a User's browser. This log information includes the User's IP address, browser type, the request URL, and timestamps. This data is automatically logged by most websites and is securely stored. The Lawful Basis for collecting and retaining these Log Files is Legitimate Interest, serving essential purposes such as internal analysis of traffic and network patterns, detecting and preventing unauthorized access, ensuring network security, and diagnosing technical faults. These Log Files are used in our internal analysis of traffic patterns and are crucial for the administration and reliable operation of our cloud services.

4. How We Use Information That We Collect

We use the Customer Record to identify Users personally and throughout our business to provide the contracted Services. Customer Inquiry Information is used to identify Users and is shared with third parties only when necessary to diagnose and fix problems with the services we provide. Survey Information is used internally to market new products and services to Users and is shared with third parties only in aggregate form that does not identify Users personally. Statistical Information is used to operate and administer our hardware and software, diagnose network problems, and may be used in aggregate to modify our product offerings. Where information collected from Statistical Information, Cookies, and Tracking Software is combined with other data to individually identify a User for the purpose of targeted advertising or deep analytics, such processing is done only after obtaining the User's separate, specific Consent.

5. Data Retention, Security, and Cross-Border Transfer

We are legally required to limit the retention of Personal Data to the period necessary to fulfil the purposes for which it was collected. Therefore, Zeacloud will retain your Personal Data for the duration of your active contract and for a necessary legal compliance period thereafter, typically three (3) years post-termination, to meet statutory accounting and legal obligations. Once this period expires, all Personal Data will be securely deleted or anonymized. Information collected by us is protected using industry-standard security measures, including TLS encryption during transmission. However, no means of communication is totally secure, and we are not responsible for loss or corruption of information outside of our reasonable control. As a global cloud service provider, Zeacloud may transfer and store Personal Data to data centers or sub-processors located outside of India or the European Economic Area (EEA). Where this occurs, Zeacloud ensures that adequate safeguards are in place, such as implementing the Standard Contractual Clauses (SCCs) approved by the European Commission, or relying on the Data Fiduciary's specific Consent as permitted under the DPDPA.

6. Links to Third-Party Websites

We may provide links on our Website or within our Services to the websites, applications, or resources of other third parties. Please be aware that these third-party websites or applications are not governed by this Privacy Policy. These external parties may collect Personal Information about You through their own means, and our Privacy Policy and data handling practices do not extend to these external websites and their data collection. We encourage You to review the privacy policies of any third-party sites You visit. Links to third-party sites do not imply endorsement or approval of those sites by Zeacloud, and we cannot accept responsibility or liability for the content or privacy practices of any websites not controlled by us.

7. Data Security, Disclosure, and Right to Withdraw Consent

Zeacloud confirms that we will not sell, trade, or disclose to third parties any Personal Information derived from the registration for, or use of, any online service (including names and addresses) without your consent, unless required under applicable law, such as a legally binding subpoena or warrant. We may, however, disclose this information to our Members or Affiliates only for the purposes of confirming your registration, providing the Services to which you are entitled, or, where necessary, to alert other businesses and individuals to potential risks in connection with credit or lending. We will take appropriate steps and implement reasonable security practices and procedures and strict policy guidelines to safeguard the privacy of your personally identifiable information from unauthorized access and improper use or disclosure, in compliance with the Information Technology Act, 2000. Despite these efforts, we cannot guarantee that unauthorized access will never occur, as there is always an inherent risk in transmitting information over the Internet. Right to Withdraw Consent: Upon the withdrawal of consent by You, all Personal Information shared by You or any Consumer will cease to be used by Zeacloud for any purpose based on that consent. You may withdraw the consent by way of unsubscribing from the services offered by Zeacloud or by sending a written notice of withdrawal to Zeacloud using the contact details of the Grievance Officer provided in the Terms of Use. We are also not responsible for the authenticity or accuracy of any information which is provided by you.

8. Subpoenas and Demands for Information

Zeacloud is required to comply with lawful demands for information, including subpoenas, warrants, and civil discovery demands, as required by state and central government law. If we receive such a demand, we will, in our assessment, disclose only the minimum information necessary or required to comply with the law. We commit to making a reasonable effort to notify You prior to any such disclosure, unless we are legally prohibited from doing so by the demanding authority or if we determine, in our sole discretion, that notifying You would pose an immediate risk to our network, our customers, or in connection with the sale of our business.

9. Children's Privacy

The Services and the Website are neither intended nor designed to attract or be otherwise used by children under the age of eighteen (18) years. By using the Website or Services, You affirm that You are either 18 years of age or more, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into this Privacy Policy and the Terms of Use. Children under 18 years of age should not submit any Personal Information to us without the express consent of their parent or legal guardian. If You are a parent or legal guardian and believe that your child has submitted Personal Information to Zeacloud without your permission, please contact us immediately using the Grievance Officer details. We will take reasonable efforts to remove that information from our systems in compliance with all applicable laws.

11. Data Principal Rights and Grievance Redressal

In compliance with the DPDPA and GDPR, You, as the Data Principal, have certain rights regarding your Personal Data, including the right to access your information, the right to demand correction or completion of inaccurate data, and the right to request the erasure of your Personal Data or withdraw your consent for processing where consent is the legal basis. Any request to exercise these rights, or any complaint or grievance with respect to this Policy or the handling of your Personal Data, must be submitted to our designated Grievance Officer in writing.

12. Governing Law

This Privacy Statement is governed by the laws of India. Any action, suit, or other legal proceeding, which is commenced to resolve any matter arising under or relating to this Policy website, shall be subject to the exclusive jurisdiction of the courts at Noida / Delhi, India.
